injuries he did talk to this person and that person seems to be ok. as to what caused the failure that is under investigation. as far as this scene, even though the flames were very high according to witnesses they say at the highest plane was as high is the silo you see there. one person said he stepped out of his plant adjacent to the refinery and it seemed like it went on for about 10 minutes. paid smoke and flames reaching to the sky. they managed to put it at to. there is no stay in a shelter for the neighborhood, people would did some of their homes were looking loose nobody had to evacuate. they did set up a lot of roadblocks for the fire trucks to get through. as you can see they are blocking the road way here at cherry and

>> reporter: immane not look like much but these homes on cars and drive for them have been red tag. you can see the tape up. red tag means they have to evacuate. the problem is is the hillside behind. that green hillside is letting down.slidine problem was last week when we had the heavy rains. yesterday for more homes were yellow tagged which means folks can go in and out but it is not recommended to stay there overnight. city officials are hoping to come out today and try and stop the slide from continuing even though the rain has stopped, the hillside has continued to move. it may be an

san jose police are asking for the public's help in locating the driver of a 2004-2006 light blue honda accord involved in a hit and run that left an officer injured. sgt. jason dwyer said that approximately 1:39 p.m. at the intersection of south first street and alma avenue, officer devlin creighton was about to stop a vehicle when the honda abruptly pulled up in front of him. the officer's police motorcycle hit the honda, ejecting the officer onto the roadway. thi >> reporter: supreme court will hear arguments on whether or not wal-mart can do a case against some women now work there. we are looking for organizers who are organizing an hour rally in favor of the women that worked at wal-mart. they are rallying outside of the court house. the point here is the high court will hear arguments to decide if this case can move forward as the class

today are '60s and some of the warmer spots, san francisco 63, concord flirting with 70, 5 degrees warmer than yesterday san jose 66, livermore 66, not fog coming in at 69. so just a slight warm up today, the big warmup comes tomorrow. upper 40's san francisco, warming to 50 degrees currently in antioch. by the afternoon most of the highs will be in the '60s, looks like we will get close to the 70 degree mark. temperatures staying in to the mid-60s around the bay, 59 degrees for half moon bay down in san jose round 66. 7 day around bay, what is of sunshine had a bus. come to more we jump up to about 14 degrees in to the 80s in one spot '70s

the fire from earlier this morning at evergreen oil refinery. one person was injured will tran is live following the latest. >> will: here is the very latest the plant will shut down while they conduct an investigation. the police officers are out here making sure that only people, that have access to the plant get there so they can conduct investigation. some cars are allowed through because of their plants are in the area. as far as this place they don't know when it will reopen that. new reformation on the person injured. he was not injured from the fire but instead they may have been the jolt from the explosion. there is some saw the incoming from the plant, that is the residual effect from the explosion that happened at 5:30 a.m. it was the equipment failure when this person was going in there to inspect the

equipment. right before a change of shift. and then subsequently the fire took place, according to witnesses the fire a one. was higher than some of the silos and was going on for 15 minutes it released gas and to the air but it was not dangerous. a lot of people went out of their homes to check out what was going on. there is no danger this morning. we don't know this person was taken to hospital, not life threatening injuries and that is the good news. at 8:00 p.m. we will hear from the plant manager about why he feels this happened. --88:00 a.m.-- >> darya: are they making you aware the hard hat? >> will: we are standing on top of the plant managers property

employee went to check gone equipment, that equipment was leaking oil, that oil caught fire, the fire caused a hydrochloric tank to explode. the employer was not burned by the flames or the acid but injured by the tools of the explosion. this place has its own fire fighters and they quickly put out the flames which according to witnesses were as high as hundreds of feet in the air. it put out the fire within 15 minutes. no gases were released into the air, it was just smoke. nobody was evacuated or forced to stay in their rooms at the time. they are taking samples of air as well as the stream nearby to see if any of the acid or the phone that was used to but the flames if that manage to seep into the environment. >> reporter: san jose police
